Rhinelander man charged with sexually assaulting teen

A 30-year-old Rhinelander man has been charged with second-degree sexual assault and sexual intercourse with a child.

According to the criminal complaint, the mother of the 17-year-old alleged victim went to the Oneida County sheriff's office Sept. 3 to report that Mitchell L. Tosi had sexual contact with her daughter between Oct. 15, 2016 and Aug. 29, 2017.

The next day officers spoke with the alleged victim who claimed that, just before her 17th birthday, Tosi told her that "he liked her." Two days after her birthday, in the fall of 2016, he had sex with her at a party, she added.

She stated that the first encounter was not consensual and that she was too intoxicated, to the point of vomiting, to resist. She claimed that Tosi gave her the alcohol and that he took her to his bedroom and had intercourse with her after she had vomited from intoxication.

According to the complaint, officers interviewed two other adult attendees of the party who stated that they observed Tosi give the alleged victim alcohol until she was intoxicated to the point of vomiting, was incoherent and unable to walk. They also said they observed Tosi take the girl to his bedroom.

One of the attendees stated that Tosi had told her that "he wanted to sleep with (the alleged victim) and all of her sisters." She also claimed that Tosi had been grooming the alleged victim by giving her money and purchasing items, and had bragged about the sexual encounter at the party.

According to the complaint, the alleged victim said she and Tosi had intercourse multiple times after the party and she let him do it "to get it over with." The alleged victim also claimed that Tosi had offered to allow her to live with him and that during the course of their sexual relationship he'd pay for "all of her needs."

According to the complaint, officers have copies of text messages that confirm the sexual relationship. Officers also talked to Tosi's mother who said she confronted her son about his relationship with the alleged victim. She reported that Tosi "looked at her with a smile on his face and said he was having a sexual relationship with (the alleged victim), but it was 'only a misdemeanor' and 'not a big deal.'"

According to the complaint, when Tosi was told that he was being arrested for the felony of having sex with a minor while she was drunk, he said "that didn't happen, but I'm not saying other things didn't happen."

Second-degree sexual assault is a Class C felony. If convicted, Tosi may be fined no more than $100,000 and imprisoned for no more than 40 years, or both.

A preliminary hearing in this case is scheduled for Dec. 7.
