Defendant chooses bench trial in murder weapon-related burglary case

Oneida County Circuit Court Judge Michael Bloom will oversee a three-day bench trial in September for a man charged in connection with a 2017 burglary in Lake Tomahawk where a pistol later used to kill a Lac du Flambeau man was stolen.

Dayna Mason, 28, last listed as "homeless in Eagle River," now in Ashland Jail, waived his right to a jury trial May 9. He appeared via teleconference while his public defender, Richard Shawl, appeared in person.

Special prosecutors state assistant attorneys general Richard Dufour and Chad D. Verbeten called in via telephone.

Also charged in the crime are Joseph Cloud, 25, formerly of Lac du Flambeau and now housed at Green Bay Correctional; Richard Allen, 28, Lac du Flambeau and now of Boscobel prison; and Buddy Maurice Big John, 21, Wittenberg, now in Oneida County Jail.

Big John is scheduled for a jury trial in July. Allen's case was dismissed after he was convicted last year in the murder of Wayne Valliere, Jr.

A bench trial takes place in front of a judge rather than a jury. The judge acts as both the finder of fact and ruler on matters of law and decides the case based on evidence.
