Liebscher's attorney files motion to dismiss misdemeanor
Hearing set for Jan. 28

The 54-year-old brother of the man accused in the hit and run death of a 23-year-old St. Germain motorcyclist Aug. 28 made a court appearance last week in his obstructing an officer case.

Brian Liebscher appeared for a pretrial conference last Tuesday before judge Patrick O'Melia. His attorney Ben Lucareli appeared by telephone. Liebscher is charged with obstructing an officer, a class A misdemeanor.

Liebscher is accused of not truthfully reporting to Oneida County detectives investigating the death of Sean Holtslander that his brother Jeffrey had contacted him right after the fatal accident and that he then drove his brother to Three Lakes.

Jeffrey Liebscher was charged Aug. 30 with hit-and-run causing death and homicide by negligent operation of a vehicle related to the accident on State Highway 17.

The accident was initially reported to the Oneida County Sheriff's Department at 10:23 p.m., Aug. 28, according to the complaint against Jeffry Liebscher.

Brian Liebscher was charged Sept. 3.

Oneida County district attorney Michael Schiek told O'Melia that he and Lucareli had not reached an agreement and asked for an adjournment.

Lucareli said he planned to file a motion to dismiss due to lack of probable cause and a hearing date for the motion had already ben set for Jan. 28, 2020.

Brian Liebscher remains free on a $500 signature bond.
