Man who sent explicit text messages to teen accepts plea deal, receives DEJ

A 30-year-old Rhinelander man who faced a felony charge of exposing a child to harmful descriptions after he allegedly sent a series of inappropriate text messages to a teenage relative received a deferred entry of judgment last month after entering a guilty plea.

The River News is withholding the man's name to avoid also identifying the alleged victim.

According to a complaint filed April 12, a 16-year-old female contacted the Oneida County sheriff's office on March 25 to report a relative had sent her a series of text messages indicating he is interested in her sexually and wished he could see naked photos of her.

She showed the police the messages which also include replies where she tells him "you're not getting anything from me" and reminds him he has a wife.

"I know. It's a fantasy," the man texted back, according to the complaint. "That's not going to be lived out," the teen replied.

The teen told police the man has never touched her inappropriately but the messages made her uncomfortable.

The man entered a not guilty plea at arraignment on July 15.

At a pre-trial conference on Sept. 24, the man told Oneida County Circuit Judge Patrick O'Melia that he was accepting a plea agreement offered by assistant district attorney Jillian Pfeifer.

As part of that agreement, he pled guilty to the charge and O'Melia imposed a deferred entry of judgment for 18 months.

If the man commits no other crimes during that time, the charge will be dismissed.

If he fails to live up to the terms of the agreement, the district attorney's office may file to reopen the case, which would proceed to sentencing.

At that time, O'Melia could sentence the man to up to 3 1/2 years in prison.
