A 19-year-old Arbor Vitae man accused of sexually assaulting patients at a Minocqua residential facility last spring while working as a nursing assistant is scheduled to stand trial in August.
Jacob H. Schlosser is facing one count of second degree sexual assault of a mentally ill person and two counts of second-degree sexual assault in a treatment facility dating back to March 2019. The charges arose from Schlosser's alleged inappropriate touching of two patients he was caring for while working as a Certified Nursing Assistant. He is no longer so employed.
The defendant and his attorney Elizabeth Svehlek appeared before Judge Patrick O'Melia Tuesday for a pre-trial conference at which time Svehlek and district attorney Michael Schiek announced they have not come to a plea agreement.
Schiek also advised the court that the alleged victims have passed away since the case was filed.
"And what I have been doing is assembling a motion to basically have the court determine if the statements (of the alleged victims) are admissible or not," Schiek said. "And it (the motion) is in a rough draft form."
Schiek also said that his office has since received a thumb drive from law enforcement that had not been provided to Svehlek as part of discovery.
"It has the interviews on them, I have to give that to Ms. Svehlek," Schiek said.
Schiek said some of the interviews were recorded with an officer's body camera while others were audio-recorded.
A date for a hearing will be set after Schiek files the motion.
O'Melia scheduled a two-day jury trial and a final pre-trial date to take care of routine motions in limine.
The final pre-trial conference is scheduled for June 30, with the two-day trial set for Aug. 27 and 28. Another pre-trial date may be scheduled closer to the trial, if necessary.
If Schlosser is found guilty of the three class C felonies, he faces not more than 40 years in prison on each count.
